1. Parties, Definitions and Scope
1.1. This International Terms of Service and Membership Agreement ("Agreement") is entered into between BTPCraft SAS ("Company", "Platform", "btpcraft.com") and the natural or legal person registering on the Platform ("User", "Member"). The Company is incorporated under the laws of the French Republic, with its registered office in Paris, France.
1.2. BTPCraft consists of two primary services: an AI-powered matching platform (btpcraft.com) and a Minecraft server (mc.btpcraft.com). The Platform provides worker-employer matching, certificate equivalency, and professional networking services in the construction and technical sectors.
1.3. Definitions:
(a) "Services": Website, mobile application, Minecraft server, API services, certificate equivalency tools, and all digital products collectively.
(b) "Digital Content": Purchasable virtual products, Minecraft ranks, special items, subscription plans, premium matching credits, and any digital products offered through the Platform.
(c) "Global User": All natural person users residing in any country, including France.
(d) "Consumer": A natural person acting primarily for purposes outside their trade, business, craft, or profession (French Consumer Code, Article L. 121-16).
(e) "Subscription Plan": The paid tier of service selected by a User, including SME Basic, SME Pro, SME Enterprise, Talent Free, and Talent Pro.
(f) "Business Day": Any day from Monday to Friday that is not a public holiday in France.
1.4. This Agreement constitutes a binding contract between the parties pursuant to Article 1103 of the French Civil Code (Code civil). By registering on the Platform, the User acknowledges that they have read, understood, and agree to be bound by this Agreement and its annexes (including the Privacy Policy and Refund Policy).
2. Service Terms, Age Restrictions and Account Security
2.1. Age Restriction: You must be at least thirteen (13) years of age to use the Platform. Users between the ages of 13 and 18 may only use the Platform with the explicit consent of a parent or legal guardian. BTPCraft reserves the right to request parental consent for users under 16 pursuant to COPPA (Children's Online Privacy Protection Act) and Article 8 of the GDPR.
2.2. Registration Obligations: The User is solely responsible for the accuracy, currency, and completeness of the information provided during registration. The User is obligated to update their account information promptly upon any change. Providing false, incomplete, or outdated information may result in account suspension or permanent closure.
2.3. Account Security: The User is exclusively responsible for maintaining the confidentiality of their password and account credentials. The User is liable for all activities occurring under their account. In the event of unauthorized access or security breach, the User must immediately notify BTPCraft at info@btpcraft.com.
2.4. Multiple Account Prohibition: Each user may only open one (1) account. Creating multiple accounts is strictly prohibited and will result in the permanent closure of all accounts upon detection.
2.5. Minecraft Server Rules: The following additional rules apply to the Minecraft server:
(a) Use of cheats, automated software (bots), macros, or any third-party automation tools is prohibited.
(b) DDoS, brute-force, or other cyber attacks against the server are prohibited.
(c) Exploits, bug abuse, or misuse of server vulnerabilities are prohibited.
(d) Racism, discrimination, hate speech, sexual harassment, or any illegal conduct is prohibited.
(e) Violation will result in a permanent IP-MAC based ban. Ban appeals may be submitted via info@btpcraft.com.
3. Intellectual Property Rights and License
3.1. Ownership: All content, software, source code, design, logos, graphics, text, audio, video materials, database schemas, and algorithms on the Platform ("BTPCraft Content") are owned by BTPCraft SAS and protected by the French Intellectual Property Code (Code de la propriété intellectuelle, CPI), national and international copyright laws.
3.2. User License: The User is granted a limited, non-exclusive, non-transferable, revocable license to use the BTPCraft Content solely within the scope of the functionalities provided by the Platform. The User may not copy, distribute, modify, reverse-engineer, or create derivative works from the BTPCraft Content.
3.3. User-Generated Content: Users retain ownership of content they share on the Platform (profile information, photos, videos, messages, comments). By submitting content, Users grant BTPCraft a worldwide, non-exclusive, royalty-free, revocable license to use such content for the purposes of operating, developing, promoting, analyzing the Platform, and fulfilling legal obligations. This license terminates upon deletion of the User's account, subject to BTPCraft's legal retention obligations.
3.4. DMCA and French Law Copyright Infringement Notice: Copyright holders wishing to report infringement must submit a written notice to info@btpcraft.com containing:
(a) Physical or electronic signature of the authorized representative,
(b) Identification of the copyrighted work claimed to have been infringed,
(c) Identification of the infringing material and its location (URL) on the Platform,
(d) Contact information (address, telephone, email),
(e) A statement of good faith belief that use is not authorized by the copyright owner or agent,
(f) A statement, made under penalty of perjury, that the information is accurate.
3.5. BTPCraft shall comply with takedown notices pursuant to the DMCA and applicable French law (including the French Law of July 28, 2023 on digital services adapting the DSA), removing infringing content and notifying the relevant user upon receipt of a valid notice.
4. Digital Product Sales, Subscriptions and Payments
4.1. Digital Product Delivery: Digital products purchased on the Platform (Minecraft ranks, special items, subscription plans, virtual credits) are delivered digitally at the time of purchase. Delivery is deemed to have occurred once the product is credited to the User's account.
4.2. Withdrawal Right Exception: Pursuant to Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) and Article L. 221-28 of the French Consumer Code (Code de la consommation), digital content delivered with the consumer's express consent and for which performance has begun before the expiry of the withdrawal period is exempt from the right of withdrawal. The User expressly acknowledges and agrees to this exception at the time of purchase.
4.3. Pricing and Payments: All purchases are transacted in EUR (Euro). The User accepts any currency exchange differences, conversion fees, and bank charges arising from their payment method. BTPCraft reserves the right to change pricing upon notice; however, changes shall not apply to the current billing period.
4.4. Payment Processor: All payments on the Platform are processed by Paddle.com Inc. and its affiliates as the Merchant of Record. Paddle handles all tax compliance (including VAT), invoicing, and chargeback management. BTPCraft does not store your full payment card details.
4.5. Chargeback Policy: If a User initiates an unjustified or bad-faith chargeback:
(a) The account will be immediately suspended,
(b) Transaction records and supporting documentation will be submitted to the relevant payment provider,
(c) If the chargeback is determined to be unjustified, the account will be permanently closed,
(d) BTPCraft reserves the right to seek recourse against the User for all damages incurred, including chargeback fees and administrative costs.
4.6. Exceptional Refunds: If a product cannot be delivered due to a technical error or the wrong product is delivered, BTPCraft will replace the product or issue a refund within fourteen (14) business days. See our Refund Policy for detailed terms.
5. Data Privacy, Processing and Security
5.1. Applicable Law: BTPCraft processes user data in compliance with the French Data Protection Act (Loi Informatique et Libertés, Law No. 78-17, as amended), the EU General Data Protection Regulation (GDPR 2016/679), and all other applicable data protection legislation. Rights under the California Consumer Privacy Act (CCPA) are reserved for California residents.

5.3. Processing Purposes: Personal data is processed for registration and account management, service provision and personalization, matching algorithm operation, payment processing, legal compliance, and fraud prevention.

6. Account Termination, Suspension and Penalties
6.1. BTPCraft reserves the right to unilaterally suspend or permanently close a User's account without prior notice in the following circumstances:
(a) Violation of this Agreement or Platform rules,
(b) Use of cheats, bots, automated software, macros, or exploits,
(c) Cyber attacks against the Platform (DDoS, SQL injection, XSS, brute-force, phishing, etc.),
(d) Use of false, misleading, or third-party identity information,
(e) Harassment, threats, bullying, or fraud against other users,
(f) Racism, discrimination, hate speech, illegal content sharing, or criminal activities,
(g) Creating multiple accounts or account transfer,
(h) Payment fraud, unjustified chargebacks, or failure to meet payment obligations,
(i) Conduct that disrupts or impedes the normal operation of the Platform.
6.2. Consequences of Account Termination:
- Access to all purchased digital products, subscriptions, and content ceases immediately,
- No refund or compensation shall be provided for prepaid fees (constituting a penalty clause pursuant to Article 1226 of the French Civil Code),
- IP addresses, device fingerprints, and other identifiers may be added to a permanent blocklist,
- Where required, notification may be given to the public prosecutor's office and/or relevant law enforcement authorities.
6.3. BTPCraft reserves the right to claim damages for all losses suffered as a result of the User's breach of this Agreement, pursuant to Article 1231-1 of the French Civil Code.
7. Limitation of Liability and Warranty Disclaimer
7.1. Warranty Disclaimer: The Platform is provided on an "AS-IS" and "AS AVAILABLE" basis. BTPCraft does not warrant that the Platform will be uninterrupted, error-free, secure, or virus-free, nor does it provide any warranty of merchantability or fitness for a particular purpose. This disclaimer is subject to the provisions of the French Consumer Code (Articles L. 217-1 et seq.) to the extent applicable.
7.2. Limitation of Liability: BTPCraft's liability is limited to the maximum extent permitted by applicable law. Under no circumstances shall BTPCraft be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data loss, business interruption, or loss of reputation.
7.3. Pursuant to Article 1231-1 of the French Civil Code, BTPCraft's total aggregate liability shall not exceed the total fees paid by the User in the twelve (12) months preceding the event giving rise to the claim. This limitation shall not apply in cases of BTPCraft's gross negligence (faute lourde) or willful misconduct (dol).
7.4. User Interactions: BTPCraft is not directly or indirectly liable for interactions between Users (job interviews, contracts, payments, disputes, hiring decisions). The Platform merely provides a matching tool; the employer-employee or contractor-subcontractor relationship is established between Users.
7.5. Force Majeure: BTPCraft shall not be liable for failure to perform its obligations due to acts of God, war, terrorism, pandemic, government regulations, internet infrastructure disruptions, cyber attacks, or other events beyond BTPCraft's reasonable control (Article 1218 of the French Civil Code).
7.6. Nothing in this Agreement shall limit or exclude BTPCraft's liability for gross negligence (faute lourde), willful misconduct (dol), personal injury, or death.
8. Dispute Resolution, Governing Law and Jurisdiction
8.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the French Republic, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to any transaction under this Agreement.
8.2. Consumer Rights: For consumers resident in the European Union: Rights under the EU Consumer Directive (2011/83/EU), the GDPR, and mandatory consumer protection laws of the country of residence are reserved. In the event of a violation of these rights, the consumer has the right to seek recourse in the courts of their country of residence. Nothing in this Agreement deprives you of the protection afforded by mandatory consumer protection laws of your country of residence.
8.3. US Users: Rights under the CCPA and California law are reserved for residents of California.
8.4. Dispute Resolution Process:
(a) Amicable Resolution: First, submit a written application to BTPCraft customer service at info@btpcraft.com, including a description of the claim, the remedy sought, and supporting documentation.
(b) Mediation: If the dispute cannot be resolved within thirty (30) business days of receipt, the parties may submit the dispute to mediation before the Paris Centre for Mediation and Arbitration (CMAP).
(c) Arbitration: If mediation fails, the parties may mutually agree to submit the dispute to binding arbitration in accordance with the CMAP arbitration rules.
(d) Judicial Relief: For business users, the Commercial Court of Paris (Tribunal de commerce de Paris) shall have exclusive jurisdiction. Consumers may also bring proceedings in the courts of their habitual residence.

8.6. Severability: If any provision of this Agreement is held to be invalid, void, or unenforceable, the remaining provisions shall remain in full force and effect (Article 1184 of the French Civil Code). Any invalid provision shall be interpreted or adapted to reflect as closely as possible the parties' economic intent.
9. Entire Agreement, Modifications and Notifications
9.1. Entire Agreement: This Agreement, together with its annexes (Privacy Policy and Refund Policy), constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, and representations relating to the use of the Platform.
9.2. Waiver: BTPCraft's failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver of a right or provision shall be effective only if in writing and signed by an authorized representative of BTPCraft.
9.3. Assignment: The User may not assign this Agreement or any rights or obligations hereunder without BTPCraft's prior written consent. BTPCraft may assign this Agreement to a third party at any time in connection with a merger, acquisition, or sale of assets.
9.4. Modifications: BTPCraft reserves the right to unilaterally modify this Agreement with or without prior notice. Material changes (limitations of liability, governing law, privacy policy) will be communicated to the User via email or Platform notification at least fifteen (15) days in advance. Continued use of the Platform after the effective date of the changes constitutes acceptance of the updated terms.
9.5. Language: This Agreement is drafted in Turkish and English. In the event of any conflict in interpretation, the English text shall prevail.
